I've been saying that for about 3 decades. It's obvious once you've seen it over and over again, especially with these ridiculous cases.
We are governed by insane/corrupt men, not laws.

The Napoleonic code system is designed to minimize the influence of the trial judge. In the old common law system, the jury had greater power to check the judge which has now been lost. The prerogative writs were also actually employed by the higher courts to check mischief by the lower court judges, who could also be made to pay the cost of those proceedings as it was not good behavior. That has also been lost.

Thank you for informing me of this. It has been a long winding road to get from what used to be a functional judiciary to the dysfunctional one we have now.

I have long blamed FDR and Truman for the mess that is our Federal Judiciary, but what you have told me gives me further insight into the matter.
